Trespass Appeal Process

  • An individual who has been issued a Trespass Warning to leave County property can appeal the warning. 
  • The individual shall file a written appeal within 14 (fourteen) days, including weekends and holidays, from the date the warning is issued. He/she must include their name, address, email address, and telephone number, along with a copy of the warning and a statement as to why he/she seeks to have the County revoke this warning. The request for appeal shall be sent to Martin County Board of County Commissioners, Attn: Administration, 2401 SE Monterey Road, Stuart, Florida 34996. 
  • A response will be issued to the individual within 14 days of receipt by the County. 
  • If the Trespass Warning is revoked, the County Administrator, or his/her designee, shall notify the governing law enforcement agency which issued the trespass warning and the Assistant County Administrators’ Office, of the revocation of the warning. The Assistant County Administrators’ Office shall immediately issue an updated Trespass List, addressing the revocation. 
  • During any time a Trespass Warning is in effect, and where the individual needs to return to the specific property from which he/she has been trespassed from for official business, he/she must contact County Security at (772) 288-5400 prior to returning to allow temporary and limited access or to provide an alternative accommodation.
